Welcome to FBPostback.com (the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree to these Terms, you may not use the Platform.

1. Use of the Platform

1.1 The Platform is designed for media buyers, agencies, and pay-per-call marketers to manage and improve conversion tracking. 1.2 Users are responsible for:

  • Complying with Facebook's Terms of Service and any other applicable third-party terms.

  • Providing accurate first-party data for use within the Platform.

  • Ensuring the security of authentication tokens and limiting unauthorized access. 1.3 Misuse of the Platform, including but not limited to unauthorized access, fraud, or violating these Terms, is strictly prohibited.

2. Subscriptions and Payments

2.1 The Platform operates on a recurring monthly subscription basis, with additional overage charges for exceeding allocated API usage. 2.2 If a subscription payment fails or is not properly processed, access to the Platform may be limited or suspended until payment is resolved. 2.3 Refunds are not provided unless otherwise required by law. All plans include a 7-day free trial. You may cancel at any time during the trial period at no charge.

3. Termination

3.1 We reserve the right to terminate or suspend your account for:

  • Misuse of the Platform.

  • Non-payment of fees.

  • Fraudulent activity.

  • Extended inactivity (no API calls for 6+ consecutive months), with 30 days' written notice to your registered email before termination.

  • Facebook-related compliance flags.

3.2 Upon termination, you will retain access to your account until the end of the current billing period. Data associated with your account will be retained for 30 days following termination, after which it will be permanently deleted.

4. TCPA Disclosure

4.1 The Platform processes phone call data provided by users through call tracking platforms (e.g., Ringba, Retreaver). This data is hashed using SHA-256 encryption before being transmitted to Meta (Facebook) via the Conversion API.

4.2 By using the Platform, you represent and warrant that you have obtained all necessary consents from callers for the processing and sharing of their phone data for advertising attribution purposes, in compliance with the Telephone Consumer Protection Act (TCPA) and any applicable state or federal regulations.

4.3 FBPostback does not record, monitor, or store phone calls. We act solely as a data relay between your call tracking platform and Meta's Conversion API.

5. Liability

5.1 The Platform is provided "as is" and "as available." We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform, except as required by law. 5.2 You agree to hold us harmless for any losses related to data inaccuracies, system downtime, or misuse.

6. Dispute Resolution

6.1 Any disputes, including chargebacks, shall be resolved through arbitration in Dade County, Florida.

7. Updates to the Terms

7.1 We may update these Terms from time to time. Changes will be notified via a banner on the website. Continued use of the Platform constitutes acceptance of the updated Terms.
